The Rate of Divorce in Brazil. The Results of the Year 2019 – Sponsored

RIO DE JANEIRO, BRAZIL – In the past, couples would have to prove why they were getting divorced and get approval from a judge before the divorced could be granted. Therefore, for a long time, Brazil had some of the lowest divorce rates in the world. But since the laws changed in 2010, Brazil has seen a 46 percent increase in divorce rates.

According to IBGE and onlinedivorce.com statistics, in 2011, Brazil saw a record of more than 350 000 divorces granted. The rate of divorce in 2011 was 2.6 for every 1000 inhabitants over the age of 15 years old. This marked the highest rate since 1984. And since 2011, divorce has been on the rise.

The length of time it takes to get divorced has also changed. Couples no longer have to wait for long periods of time for their divorce, especially if they don’t have children. With the new laws, couples that got married last wek could file for a divorce the following week. Previously, this was impossible. Under the old laws, a couple had to be separated for one year before they could file for a divorce.

Another reason why divorce has become more prominent in Brazil is that if no children are involved, your divorce can be performed by a notary instead of a judge.

There are two types of divorce in Brazil. The first one is called Cartorio Divorce. Cartorio Divorce is the fastest and easiest option. This option is for those who would like to register for a consensual divorce.

Similar to an uncontested divorce, the couple is in agreement with all of the terms of their divorce, such as how to split assets and debts, child custody and so forth. This is the cheapest form of divorce.

The other type of divorce is a judicial divorce. Judicial divorce is much more complex and time-consuming. It is incredibly expensive, as both couples will have their own lawyers representing them. This is similar to a contested divorce where couples can not come to an agreement.

Since the laws have changed, a couple can get a divorce within 4-8 weeks.

Documentation that you would need include:

  • Your marriage certificate
  • A notarized declaration from your spouse saying that they agree to the divorce
  • A document if requesting a name change after the divorce

It is interesting to note that divorce was illegal in Brazil until 1977. And despite the recent changes, Brazil still has the 8th lowest divorce rate in the world.

In conclusion, Brazil previously had one of the world’s lowest divorce rates, but because the laws in the country have changed, the rate of divorce is increasing. To the relief of many Brazilian couples, divorce is much easier now than it was a few years ago.

In comparison to the rest of the world, though, the rate of divorce among Brazilian couples is still relatively low. This could be because of deeply rooted religious beliefs or because many couples choose to live together nowadays, instead of getting married. Whatever the reasons, we will watch Brazil in order to see how their stats change over time.
